Akosua Serwaa Seeks Appeal Court Reversal In Marriage Dispute

Akosua Serwaa, the first wife of the late highlife icon Daddy Lumba, has taken her legal battle a step further by challenging a Kumasi High Court decision that dismissed the marriage certificate she relied on to establish her marital status.

The appeal, filed on December 1, 2025, asks the Court of Appeal to overturn the ruling delivered days earlier by Justice Dorinda Smith Arthur. Akosua Serwaa maintains that the trial court’s conclusions were flawed and unjust, and insists the judgment should not be allowed to stand.

Court documents indicate that her dissatisfaction stems from the High Court’s November 28, 2025, decision, which rejected the evidential value of the marriage certificate she presented during proceedings.

“Please take notice that the Plaintiff/Appellant herein being aggrieved and dissatisfied with the Judgment of the High Court, Kumasi more particularly stated herein and contained in the Judgment of His Ladyship Justice Dorinda Smith Arthur sitting at the High Court, Kumasi and dated on the 28th day of November, 2025 do hereby appeal to the Court of Appeal against the decision upon the grounds set out in paragraph 3 and will at the hearing of the appeal seek the reliefs set out in paragraph 4,” part of the suit reads.

In outlining her grounds of appeal, Akosua Serwaa argues that the trial court wrongly concluded that the marriage certificate she submitted could not be admitted as evidence. She further contends that the judge misapplied the law by placing undue emphasis on provisions of the Evidence Act and by preferring the testimony of the defendants over hers.

“The High Court erred when it held that the Marriage Certificate exhibit ‘B’, ‘B1’ and ‘B2’ was not admissible per se. The Court erred when it held that Section 161 of the Evidence Act is a condition precedent for putting weight on an admitted document. The Court erred when it held that the evidence adduced by the defendants was more credible than that of the evidence of the complainant,” another part of the suit stated.

Her legal counsel, William Kusi, is therefore urging the appellate court to nullify the entire decision and rule in her favour.

“That the whole judgment of the High Court be set aside and judgment entered in favour of the Plaintiff,” it added.

The contested ruling, delivered on November 28, 2025, recognised both Akosua Serwaa and Priscilla Ofori, widely known as Odo Broni, as surviving wives of Daddy Lumba.

In the initial suit, Akosua Serwaa had sought a declaration naming her as the sole surviving spouse, along with exclusive widowhood rights. She also asked the court to restrain Odo Broni from presenting herself as Daddy Lumba’s wife or being acknowledged as such by the head of the Ekuona family.

The High Court, however, found that she failed to meet the required burden of proof, citing her inability to produce original copies of her marriage certificate.

Justice Dorinda Smith Arthur held that the materials presented “fell short of Sections 136 and 161,” which required the original certificate from the Bornheim Marriage Registry as well as proper certification from the Ghana Embassy in Germany. What was tendered, the court noted, was only an extract.

Speaking during an exclusive interview with ZionFelix, Prophet Kumchacha dismissed her criticism and questioned her state of mind, claiming she is dealing with depression, bipolar disorder and high fever. He said her persistent commentary showed a lack of balance and seriousness, adding that he would not normally respond if not for the nature of some of her claims.

Kumchacha was quick to clarify that he has no issue with individuals who support Akosua Serwaa or belong to Team Legal Wife. According to him, people are free to take sides and express their opinions. His concern, however, stems from a statement he attributed to Night Witch, in which she allegedly suggested she could bring down the businesses of renowned businessman Dr Osei Kwame Despite.

The outspoken preacher described that claim as reckless and unrealistic, stressing that Dr Despite’s enterprises employ thousands of people and play a significant role in the economy. He argued that it would be dangerous and irresponsible for anyone to casually speak about collapsing such businesses without considering the livelihoods at stake.

Kumchacha also used the interview to give background to how his exchange with Night Witch began, explaining that what started as casual banter gradually turned hostile as the attacks intensified.

He maintained that his response was necessary to set the record straight and draw boundaries, insisting he would not sit quietly while what he described as harmful statements were being made in his name.

According to him, registering with a production company and committing to acting slowly erased any interest he once had in mining.

“There are sticks we use to support the upper part of the holes we dig in search of gold. Sometimes, people forget how dangerous the place is due to excitement, and they end up hurting or killing themselves,” he stated.

The actor added that the relentless chase for money often clouds judgment, making people disregard obvious dangers even when they are fully aware of the possible outcomes.

“I’ve realised that wherever there’s money, blood is always spilled. It’s easy to die if you’re not vigilant,” he shared.

Despite his warnings, Kwaku Manu acknowledged the courage it takes to work in such conditions, describing those who go underground as remarkably brave given the constant threat to their lives.

“I don’t know anyone more courageous than those doing galamsey, especially those who go underground. We always panic whenever we’re going underground, but the money we know we’ll get matters the most,” he disclosed.

He concluded by admitting that the illegal nature of the work alone is rarely enough to stop people, as financial reward often outweighs fear or caution.

“We know we’re not supposed to work there, but the money involved motivated us,” Kwaku Manu further stated.
